The State of Play at the UPC from a Japanese Perspective: Insights from Active UPC Litigators

2 min Reading time
IP Event with bARDEHLE PAGENBERG in Japan, Tokyo, 14 Feb 2024

With almost 200 pending cases, the Unified Patent Court (UPC) is definitely a reality. The first substantive decisions have been issued and important trends are emerging. In particular:

  • It has become quite clear that preliminary injunctions are readily available at the UPC whereby the legal framework for obtaining interim relief is favorable to patentees. If the patentee is “good for the money”, such preliminary injunctions may even be enforceable without the need to post a bond. From the implementer’s view, protective letters are a double-edged sword since they may do more harm than good.
  • The UPC entertains forum shopping and insofar, the Munich Local Division (but also the other German Local Divisions) are apparently the place to go.

Please join us on Wednesday, February 14, 2024, at 4:30 pm JST at the Hotel Okura in Tokyo.

The UPC landscape is being shaped at breathtaking speed, requiring users to constantly adapt their strategies. Join three active UPC litigators involved in over 30 UPC actions to discuss what these developments mean from a Japanese perspective and how Japanese companies can adjust and complement their enforcement and defense strategies in light of the emerging legal framework.

You will leave this discussion with:

  • Insights into how the UPC is operating, what the UPC time schedules and case management looks like, and how internal workflows should be optimized
  • Clarity on the most relevant case law handed down by the UPC
  • Ways to improve offensive and defensive strategies involving this new forum
  • A better understanding of what the UPC really means from a Japanese perspective

After our presentation and the discussions (until 6 pm), we would be delighted to continue our exchange and to meet you personally over finger food and beverages.
